ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 12.04.2023, when learned counsel for appellants appeared and sought time to file reply. On resumed hearing today, learned senior counsel, under instructions, states that despite all endeavours, office of instructing counsel is not able to contact clients and he is appearing out of professional courtesy. He pleads lack of instructions to address arguments.
Be that as it may, when learned counsel is unable to contact appellants on the given addresses, as mentioned in memo of parties, issuance of notice by this Court would be an exercise in futility. In the premise, instant appeal is dismissed for nonprosecution with liberty to revive the same if appellants contact their counsel.
