The present petition has been filed under Section 528 of B.N.S.S for quashing of impugned order dated 05.06.2025 (Annexure P-4) passed by the learned Judicial Magistrate Ist Class, Patti, District Tarn Taran whereby cancelation report submitted by the police has been returned to the Investigating Agency for further investigation in case bearing FIR No. 25 dated 07.04.2017 under Sections 332, 186, 323, 224, 225, 440 IPC registered at Police Station Valtoha, District Tarn Taran. 2.

After arguing for sometime, learned counsel for the petitioners limited his prayer that the present FIR was registered in the year 2017 i.e. approximately 08 years ago and the investigation is still going on. The cancellation report was filed before the trial Court but same was returned by the Illaqa Magistrate on the mere ground that the complainant is not satisfied with the police report filed by the State. 3.

Keeping in view the limited prayer made on behalf of learned counsel for the petitioner and submissions made on behalf of learned counsel for the State, the present petition is disposed of with directions to respondent No.2 to complete the investigation within a period of two months.
