NIDHI GUPTA, J. (ORAL) Challenge in the present revision petition filed by the complainant/petitioner herein is to the order dated 14.08.2006, passed by the learned Additional Sessions Judge, Panipat, whereby the accused/ respondents No. 2 to 6 herein, have been acquitted in a case arising out of FIR No. 49 dated 27.04.2005 registered under Sections 498-A and 306 IPC at Police Station Israna.

On 09.08.2023, when this case was listed for hearing along with connected appeal bearing CRA-S-2242-SB-2008, following order was passed by this Court:- "Learned counsel appearing for the petitioners (in CRR-2476-2006) submits that the previous counsel has been elevated to the Bench of this Court. He further submits that he is not in touch with the petitioners since long, therefore, fresh notices may be issued to them.

Let fresh notices be issued to the petitioners (in CRRRISHU KATARIA 2024.08.14 10:54 I attest to the accuracy and authenticity of this order/judgment.

A photocopy of this order be placed on the file of other connected case."

Pursuant thereto, as per office report dated 12.02.2024, notice issued to the petitioner has been received back with the report that petitioner has died on 23.02.2013. Copy of death certificate of the petitioner dated 12.03.2013, is also enclosed with the notice. Learned counsel appearing for the petitioner submits that the matter is very old being of the year 2006 and the petitioner/complainant has also been expired on 23.02.2013. He further submits that he has no fresh instructions in the matter and even the legal heirs of the petitioner have also not contacted him. Learned counsel for the State has also not disputed the aforesaid submission of learned counsel for the petitioner. In view of the above, the instant revision petition is disposed of as having been rendered infructuous.
