Mr. S.S. Goraya, Advocate, for injured Shubham. RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Jonny alias Rajiv Singh in a case arising from FIR No.13 dated 14.03.2018 registered under Sections 307, 326, 323, 324, 148 and 149 IPC at Police Station Div. No.1, Pathankot, District Pathankot. Learned counsel inter alia contends that injury attributed to the petitioner is on the head of Shubham alias Shammi, which has been declared simple in nature. Conclusion of trial may take sufficient long time. Co-accused of the petitioner, namely, Abhishek Mahajan @ Honey has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 28.08.2018 passed in CRM-M36231 of 2018. Treating the case of the petitioner on the same parity, he may also be enlarged on bail. -2CRM-M-32143 of 2018 Learned State counsel, on instructions from ASI Jagdeesh Singh, has consented to the submission made by learned counsel for the petitioner. However, learned counsel for injured Shubham alias Shammi contends that injuries were collectively caused to Shubham by four accused, including the petitioner. As a result thereof, two fingers of injured Shubham were amputated. Therefore, it cannot be said that petitioner has not been attributed any grievous injuries to Shubham.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
