Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.557 dated 26.08.2015 under Section 354-C IPC and Section 3(1) (x) of the Scheduled Castes and Scheduled Tribes Act, registered at Police Station Sadar Rohtak, District Rohtak.

Notice of motion.

Mr.Anmol Malik, Asstt. Advocate General, Haryana, who is present in the Court, accepts notice on behalf of respondent-State and contests the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR has been got registered by VINEET GULATI 2015.09.19 14:38 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-31204 of 2015 -2Seenam. As per the allegations in the FIR, the complainant was travelling in a bus and one boy was sitting along with her and that boyaccused (petitioner) clicked her photograph on his mobile. The petitioner is in custody since 26.08.2015. He is not required for any investigation or interrogation purposes nor anything is to be recovered from him as he is in judicial custody. The presentation of challan and the trial of the case will take long time. Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, the present petition is accepted and the petitioner is ordered to be released on regular bail on furnishing bail bonds in the sum of `25,000/- with one surety in the like amount to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Rohtak.
