This is the first petition under Section 482 BNSS, 2023 read with Sectin 438 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR No.14, dated 14.02.2025, registered under Sections 420 and 120-B of IPC (correspondig to Sections 318(4) and 61 of BNS, 2023) at Police Station 'C' Division, District Police Commissionerate Amritsar. 2.

On the previous date, i.e. 17.03.2026, the petitioners were granted interim anticipatory bail and were directed to join the investigation. 3.

Today, learned State counsel assisted by learned counsel for the complainant submits that the petitioners have joined the investigation. However, it is further submitted that CRM-15173-2026 has been filed by the applicant/complainant to the effect that on the previous date, the petitioners ANU 2026.04.10 10:18 I am the author of this document Chandigarh

(O&M) -2obtained interim anticipatory bail by stating incorrect facts. It is alleged that the petitioners are not merely attesting witnesses to the documents, but are in fact beneficiaries thereof.

Assuming for the sake of arguments that the petitioners are not merely attesting witnesses but are beneficiaries of the estate, even then the dispute appears to be of civil nature, as both the parties are setting up rival Wills. It is a matter of record that civil proceedings are already pending between the parties with regard to the said Wills. In such circumstances, and particularly in view of the fact that the petitioners have already joined the investigation, their custodial interrogation is not required. 5.

Accordingly, the order dated 17.03.2026 is hereby made absolute.
