Through the present petition filed under Section 438 read with Section 482 Cr.P.C. the petitioners seek the grant of anticipatory bail in FIR No.286 dated 17.06.2020 registered under Sections 323, 34, 354A, 354B, 406, 498A and 506 IPC, at Police Station Sector 7, Faridabad, District Faridabad, Haryana.
Briefly stated, the case of the prosecution is that petitioner No.1 who is the husband of the complainant along with other co-accused raised demand of dowry and petitioners No.2 and 3 who are the brother and father of petitioner No.1 molested the complainant. Learned counsel for the petitioners contends that the petitioners have been falsely implicated in the case due to marital discord between petitioner No.1 and the complainant; the parties have compromised the RAVINDER SINGH 2020.12.17 19:24 I attest to the accuracy and integrity of this document
-2CRM-M-16339 of 2020 matter and in view of such compromise in a petition filed under Section 13-B of the Hindu Marriage Act, 1956 statements in the second motion have also been recorded and that under the interim orders passed by this Court the petitioners have not only joined the investigation but have also fully co-operated with the investigating agency. Learned State counsel on instructions of ASI Kamlesh acknowledges the fact that the petitioners and the complainant have compromised the matter and submits that under the interim orders passed by this Court petitioners have joined the investigation and that their custodial interrogation is not required.
After considering the totality of the above facts the order of this Court dated 24.06.2020 granting ad-interim anticipatory bail to the petitioners is made absolute.
