CHANDIGARH Criminal Misc. No.M-16618 of 2019 Date of decision : 31.05.2019 Rimpy ... Petitioner

Versus

State of Haryana .. Respondent CORAM :HON'BLE MR.JUSTICE ANUPINDER SINGH GREWAL Present :

Mr. Keshav Pratap Singh, Advocate for the petitioner. Mr. D.R. Singla, DAG, Haryana.

----- Anupinder Singh Grewal, J. (Oral) The petitioner is seeking regular bail in FIR No. 338, dated 10.08.2018, under Sections 324, 452, 307, 34 and 120-B of the Indian Penal Code, registered at Police Station Kurukshetra University, Kurukshetra. Learned counsel for the petitioner contends that the allegations against the petitioner are that she was not named in the FIR wherein it had been alleged that co-accused, namely, Rinku had inflicted injuries on the neck and stomach of Sunder Lal who is the husband of the petitioner. The petitioner has been arrayed as an accused on the disclosure statement of Rinku that he had inflicted injuries at the behest of the petitioner. He also contends that the injured has fully recovered and the petitioner is in custody for over nine months since her arrest on 25.08.2018. She has a four year old daughter to look after and she is not involved in any other case.

Criminal Misc. No.M-16618 of 2019 -2- ------ Learned State counsel, on instructions from ASI Balbir Dutt states that 10 out of 21 prosecution witnesses have been examined. Heard.

In view of the submissions of the learned counsel for the petitioner especially when the petitioner is a lady with minor daughter, she is in custody for over nine months and conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on her furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
