Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.0378 dated 14.12.2017, registered under Sections 420 and 468 IPC, Police Station Sector 14, Gurugram and all subsequent proceedings arising therefrom, on the basis of compromise dated 03.01.2019 (P-2).
Pursuant to order dated 08.04.2019 of this Court, the parties appeared before the trial Court on 21.05.2019 along with receipts of `15,000/- to get their statements recorded. Learned Judicial Magistrate Ist Class, Gurugram, has submitted her report vide letter bearing No.818 SONIKA 2019.05.24 09:46 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-16082 of 2019 --2-- dated 22.05.2019 duly forwarded by learned District and Sessions Judge, Gurugram, vide letter bearing No.1278/C-29 dated 22.05.2019. According to the report, ld. Judicial Magistrate Ist Class, Gurugram, is satisfied that compromise has been effected between the parties is genuine, voluntarily and without any pressure and undue influence. No accused has been declared as proclaimed offender. Considering the report of ld. Judicial Magistrate Ist Class, Gurugram, dated 22.05.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.0378 dated 14.12.2017 along with all subsequent proceedings arising therefrom, is quashed qua the petitioner only. Disposed of accordingly.
