Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.12 dated 23.01.2015 under Section 15 of the NDPS, registered at Police Station Guhla, District Kaithal.

Notice of motion.

Mr.Anmol Malik, Asstt. Advocate General, Haryana, who is present in the Court, accepts notice on behalf of respondent-State and contests the petition.

Police record is also available.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record I find that as per the FIR, 7 kgs. 200 grams of poppy husk was recovered from the motorcycle of the VINEET GULATI 2015.09.19 14:38 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-31301 of 2015 -2petitioner. The petitioner is in custody since 24.01.2015. The recovery of poppy husk from the petitioner falls under non-commercial quantity. The petitioner is not required for any investigation or interrogation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.

Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, the present petition is accepted and the petitioner is ordered to be released on regular bail on furnishing bail bonds in the sum of `25,000/- with one surety in the like amount to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kaithal.
