As per the office report, the sole appellant and respondent No. 1 refused to accept the summons and respondent No. 3 has gone abroad. 2.

On the last date of hearing, no one had appeared on behalf of the appellant. Today again, there is no representation on behalf of the appellant. It seems that appellant is not interested in pursuing the present appeal. 3.

In light of the above, the present appeal stands dismissed for non-prosecution with liberty to the appellant to seek its revival, in case, any cogent cause of action survives.
