Ms. Samina Dhir, Deputy Advocate General, Punjab. *** Learned counsel for the petitioner states that petitioner has since joined the investigation. This fact is conceded by learned State counsel on instructions from HC Bhupinder Singh. He states that recovery has already been effected from him and in that way he is not required by the police for further investigation. Under such circumstances, the interim bail granted to the petitioner on 4.9.2017 is made absolute, subject to his fulfilling conditions under Section 438(2) Cr.P.C.

The petition stands allowed accordingly.

While parting with the discussion, it has come out that despite a direction being issued that the investigating officer himself or some responsible officer from the Police Station should appear in this Court, a police official of the rank of Head Constable has been sent. The State counsel has been directed to get the necessary explanation from the SSP of the District and then place it before this Court at the earliest. The Registry shall put up the explanation as and when it is filed. (H.S.
