Through the present petition filed under Section 438 Cr.P.C. the petitioner seeks the grant of anticipatory bail in FIR No.10 dated 05.02.2020, registered under Sections 452, 323, 325, 506 and 34 IPC at Police Station Mukerian, District Hoshiarpur. The case of the prosecution is that on 25.01.2020 at about 6.00 a.m. when the complainant was sleeping in his room the petitioner along with his co-accused attacked him. The petitioner was alleged to have given simple injuries to the complainant whereas other co-accused inflicted other injuries upon him.
Learned counsel for the petitioner inter alia contends that the petitioner who is a 20 years old boy has been falsely implicated in the case; even if the allegations in the FIR are taken to be correct, though vehemently denied, the petitioner is attributed only simple injuries; there is no other RAVINDER SINGH 2020.10.06 13:41 I attest to the accuracy and integrity of this document
-2CRM-M-16355 of 2020 criminal case in which the petitioner is involved; there is unexplained delay of 11 days in lodging the FIR and that under the interim orders dated 24.06.2020 passed by this Court the petitioner has not only joined the investigation but has also fully co-operated with the investigating agency. Learned State counsel on instructions from ASI Sukhdev Singh submits that under the interim orders passed by this Court the petitioner has not only joined the investigation but has also fully co-operated with the investigating agency and that his custodial interrogation is no longer required by the State.
The petitioner is a young boy; he is not involved in any other criminal case; the injuries attributed to him are simple in nature; he has not only joined the investigating but has fully co-operated with the investigating agency and as per learned State counsel his custodial interrogation is not required.
In view of the above, the order of this Court dated 24.06.2020, granting ad-interim anticipatory bail to the petitioner is made absolute.
