(Oral) The allegations against petitioner Amit Kumar Bhardwaj @ Arjun in this anticipatory bail are that while working as a salesman in the firm M/s Kharbanda Trading Company owned by the complainant Davneet Singh, he is alleged to have forged certain bills of the owner and in the process has duped the owner of a sum of Rs 15/16 lacs. The contention of the counsel for the petitioner is that coaccused Neetu has been granted similar relief and that there is no evidence to link the petitioner with the commission of the offence though on behalf of the State the bail application is opposed and Mr.

GS Verma, Advocate on behalf of the complainant has sought to show much vehemence and opposition to the stand of the petitioner side. However, having regard to the own admission of the prosecution that the alleged documents stated to Dalbir Singh Tiwana 2016.12.23 16:52 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.

Criminal Misc. No. M-32253 of 2016 -2be forged and fabricated were never sent for analysis and there is neither any evidence to show that the petitioner was responsible for forging the same, without adverting to the merits of the case, the present petition is allowed. In the event of arrest, the petitioner shall be released on bail to the satisfaction of arresting/investigating officer till submission of report under section 173 Cr.P.C. (challan). The petitioner shall, however, join the investigation as and when called for and shall also abide by the conditions specified under section 438 (2) Cr.P.C. Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. ( Fateh Deep Singh ) December 22, 2016 Judge 'tiwana'
