Learned counsel for the petitioner submits that petitioners have already surrendered before the trial Court and has been released on interim bail and their bail bonds and surety bonds have been accepted. The petitioners have been summoned on the complaint filed by Income Tax Department. Conclusion of the trial will take considerable long time and no useful purpose would be served by keeping the petitioners in jail during trial.

Without expressing any opinion on the merits of the case, this petition is allowed and the order dated 01.02.2017 is made absolute subject to the condition that petitioners shall appear before the trial Court on each and every date.
