IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CRM-M-32329 of 2018 (O&M) Date of decision : July 31, 2018 Kajal and another ... Petitioners

VERSUS

State of Punjab and others ... Respondents

CORAM:

HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Petitioners in person with Mr. Sanjeev K. Virk, Advocate.

SURINDER GUPTA, J.(Oral) Learned counsel for petitioners submits that petitioner No.2 -Gurpreet, who is about 20 years of age, has married with petitioner No.1, who is 19 years of age. Without seeking any relief on the validity of marriage of parties, he confines his submission only for grant of protection to the lives and liberty of petitioners as they have married without consent and against the wishes of private respondents, who are parents of petitioner No.1. He submits that after the marriage of petitioners, private respondents are posing threat to their lives and liberty. Petitioners are ready to face the consequences of their marriage as petitioner No.2 has not attained the age of 21 years. At this stage, their concern is about their safety only.

In view of above submission of learned counsel for petitioners, this petition is disposed of with direction to respondent No.2-Senior Superintendent of Police (Rural), Jalandhar, to look into the representation dated 24.07.2018 (Annexure P-5), verify the submissions made therein regarding threat to lives and liberty of petitioners and take appropriate action in accordance with law, on receipt of copy of this order along with representation in his office.

However, it is made clear that this order will have no effect on the validity of alleged marriage of the petitioners or shall not be interpreted as giving protection to them from any civil, criminal or other proceedings instituted/pending against them.
