Petitioner-Sukhram filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 134 dated 11.6.2014, under Section 376 IPC and Section 3 & 4 of Prevention of Children from Sexual Offences Act, 2012, registered at Police Station Sarabha Nagar, Ludhiana, District Ludhiana.

Notice of motion.

Ms. Shivali, learned AAG, Punjab, has put in appearance on behalf of the respondent-State and contested this petition. Police record has also been produced.

From the record, I find that as per the allegation in the FIR, the petitioner committed rape upon the prosecutrix, who was about 12 years of age.

CRM-M-32281-2016 -2Keeping in view the nature and gravity of the offence, I do not find it a fit case where the petitioner is entitled for benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.

However, keeping in view the fact that the petitioner is in custody since 11.06.2014, the trial Court is directed to expedite the trial by giving short dates and if required day-to-day basis and dispose of the case expeditiously.
