 !"#  $ Allegations against the petitioner Arshdeep Singh in this petition filed under Section 438 Cr.P.C. seeking anticipatory bail in case FIR No.141 dated 24.09.2013 registered at Police Station Bhikhiwind, District Tarn Taran under Sections 419/420/467/ 468/471/120B IPC, are that a power of attorney bearing No.77 dated 10.10.2012 was registered in the name of the petitioner at the office of Sub Registrar, Patti, District Tarn Taran regarding the land owned by late Sant Baba Virsa Singh, founder of Gobind Sadan, Delhi in respect RATTAN PAL SINGH 2015.11.06 16:02 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court



    of the property popularly known as Shiv Sadan Farm situated in Tehsil Mawana, District Meerut (UP).

Contentions of learned counsel for the petitioner Mr.H.S. Batth, Advocate that neither the petitioner is signatory to said document nor any role has been attributed to him qua commission of any offence, could not be controverted by learned State counsel and to the very query of the Court learned State counsel has conceded that nothing specific has come against the petitioner in commission of the offence.

In the light of these submissions, this Court is of the opinion that no useful purpose will be served by sending the petitioner in custody and nothing has to be recovered from him. Thus, in the event of arrest, petitioner is ordered to be released on bail to the satisfaction of the Arresting Officer till submission of report under Section 173 Cr.P.C. (challan). He shall continue to join investigation and shall furnish an undertaking that he shall abide by the conditions specified under Section 438 (2) Cr.P.C. Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court.
