Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.123 dated 10.07.2017 under Sections 406/498A/328/120B IPC, registered at Police Station City Gurdaspur. It is submitted that the matter has been amicably resolved between the parties before the Mediation and Conciliation Centre of this Court on 17.11.2017. Settlement/agreement dated 17.11.2017 is attached with the connected file i.e., CRM No.M-27757 of 2017. The parties have decided to file a petition under Section 13B of the Hindu Marriage Act, 1955. A Demand draft bearing No.488966 dated 04.12.2017 for a sum of `1,50,000/- drawn on The Omkar Singh 2017.12.06 14:35 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-31421 of 2017 -2Hoshiarpur Central Cooperative Bank Ltd., Dasuya in favour of the petitioner's wife - Amandeep Kaur has been handed to learned counsel for the complainant in Court today in terms of the said settlement/agreement, for onward transmission to her. Photocopy of the said demand draft is taken on record subject to just exceptions. It is submitted that the petitioner undertakes to abide by the terms and conditions of the settlement. Therefore, it is prayed that this petition be allowed.
Learned counsel for the complainant verifies the factum of settlement between the parties and submits that his client has no objection in case this petition is allowed, subject to strict adherence to the terms and conditions of the settlement by the petitioner. There are no allegations on behalf of the State that the petitioner is likely to abscond, if released on bail.
Keeping in view the facts and circumstances of the case, specifically the settlement arrived at between the parties, but without commenting upon or expressing any opinion on the merits thereof, this petition is allowed. In the event of arrest of the petitioner, he be released on bail to the satisfaction of the Arresting/Investigating Officer. Petitioner shall join investigation as and when required by the Investigating Agency and comply with the conditions stipulated in Section 438(2) Cr.P.C. ( LISA GILL ) December 5 , 2017.
