The petitioner seeks the quashing of FIR No.132 dated 21.08.2015 under Sections 376/506 IPC registered at Police Station Chhajli, District Sangrur alongwith all consequential proceedings on the basis of a compromise between the parties.
Following order was passed on 09.08.2017 by this Court:- "As per report dated 18.01.2017 filed on behalf of respondent No. 1, it is mentioned that on inquiry, the FIR in question was found to have been registered falsely. Cancellation of the FIR was recommended. The Deputy Superintendent of Police, Sub Division, Dirba, however, recommended the presentation of challan against the present petitioner. Thereafter, the complainant appeared before Omkar Singh 2017.10.12 13:07 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-3229 of 2016 -2the Investigating Officer on 11.02.2016 and stated that the above said FIR was registered due to some misunderstandings. Said misunderstandings have been removed and she did not want any action to be taken against any person. It is mentioned in the said report that no further action has been taken by the investigating agency.
Learned counsel for the State prays for some time to seek instructions.
Adjourned to 10.10.2017."
Learned counsel for the State, on instructions from ASI Karamjit Singh, informs that the final report under Section 173 Cr.P.C./challan against the petitioner has since been presented.
Learned counsel for the petitioner seeks to withdraw this petition at this stage with liberty to avail remedy/remedies as may be available to him, in accordance with law.
