Petitioner seeks anticipatory bail in case arising out of FIR No.31 dated 03.02.2026, under Section 64 Bharatiya Nyaya Sanhita, 2023, Police Station Beas, District Amritsar Rural. This is the first petition for anticipatory bail.

While issuing notice of motion on 20.03.2026, following order was passed:- "Petitioner seeks anticipatory bail in case arising out of FIR No.31 dated 03.02.2026, under Sections 64 of BNS 2023 (Section 376(1) and 376(2) IPC, 1860), Police Station Beas, District Amritsar Rural. This is the first petition for anticipatory bail.
Learned counsel for the petitioner submits that the prosecutrix was a mature 21 years old girl. It was her own case that she was in a consensual relationship with the petitioner for
-2four years. The prosecutrix was possessed of sufficient maturity and understanding as to the nature of the act which she consented to. The FIR did not mention the date of the first incident of sexual relations on the pretext of marriage. It was argued that petitioner and his parents were willing for marriage with the prosecutrix and she had herself refused for the marriage. The case was got registered when marriage of the petitioner was fixed with another lady. It is urged that antecedents of the petitioner were clean and he was ready and willing to join investigation.
Notice of motion.
Mr. Kunwarbir Singh, AAG Punjab, who is present in the Court accepts notice on behalf of respondent-State and opposes the prayer for anticipatory bail arguing that in her statement under Section 183 BNSS prosecutrix reiterated her initial version.
In the given facts and circumstances of the case, in the event of arrest, petitioner shall be released on interim anticipatory bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting/Investigating Officer. Petitioner shall join investigation as and when called upon to do so and shall abide by the conditions as envisaged under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. Status report in the matter be filed on 29.04.2026." 3.
Vide order dated 20.03.2026 passed by this Court, the petitioner was granted interim anticipatory bail and was directed to join investigation.

On instructions from ASI Harbans Singh, learned State counsel submits that petitioner has joined investigation and that he was no longer required as challan had already been submitted in the Court. 5.
Learned counsel for the complainant opposes the prayer for anticipatory bail arguing that Annexures P2 and P3 affidavits of brother and mother of the prosecutrix that they themselves refused for the marriage were procured under pressure.

Considering all relevant facts and circumstances, but without commenting on merits of the case, the petition is allowed and order dated 20.03.2026, granting interim anticipatory bail to the petitioner is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023.
