M.M.S. BEDI, J (ORAL) For having been found in possession of 400 gms. of powder containing alprazolam the petitioner has been in custody w.e.f. 7.10.2012. A period of two years and four months has elapsed. The prosecution has not been able to examine a single witness. This being second application for bail, on account of changed circumstances that prosecution agency has not been able to examine the material witnesses, despite a period of two years and four months having elapsed and the co-accused having already been granted the concession of bail the petitioner, in said circumstances, cannot be kept behind bars for negligence and delay caused by the prosecution.
The petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
