It is agreed between the counsel for the parties that offence under Section 466 IPC has been wrongly mentioned in the prayer clause instead of offence under Section 465 IPC. In view of the oral request and agreed stand in the prayer clause offence under Section 466 IPC is substituted with offence under Section 465 IPC. Therefore, present order would be construed to have included offence under Section 465 IPC as well. Registry to make necessary correction in the digitized paper book.

CRM-M 31403/2015 As per allegations the petitioner is alleged to have forged and fabricated a cheque by adding an amount of Rs.41,26,100/- in favour of his proprietorship firm. However, it was only on the presentation stage when the fraud was detected. Learned counsel for the petitioner submits that the petitioner is in custody since 24.2.2015 and after completion of investigation the case is at the stage of recording of prosecution evidence. It is further stated that the case is triable by Magistrate. Learned State counsel on instructions from ASI Kapil Kumar does not controvert the factual position. In view of the custody period and the offence being triable by Magistrate the petitioner is directed to be released on bail to the satisfaction of CJM/Duty Magistrate,Ludhiana. 01.10.2015.
