JASWANT SINGH, J (ORAL) Prayer is for grant of regular bail in case FIR No.129 dated 12.08.2015 under Sections 420,467,468,120-B IPC, P.S Kurali, District SAS Nagar Mohali.

As per the allegations levelled by the complainant-Ajit Singh, the petitioner along with co-accused Balbir Singh, after execution of sale deed 07.04.2011 in respect of land measuring 3 kanal 6 marlas, in connivance with the Patwari/co-accused Pawan Kumar had fraudulently got entered mutation for excess seven marlas of land. Learned counsel for the petitioner submits that no loss has been caused to the complainant since the necessary corrections have been made in the revenue record. It is stated that the petitioner is 70 years old and has been in custody since 27.08.2015 and that the investigation qua him are over.

Learned state counsel, on instructions from HC Kesar Singh, concedes regarding the custody period as also that the

CRM-M- 31405 of 2015 #2# investigation qua the petitioner is over.

Without commenting upon the merits of the case and taking into account the custody period and the fact that the trial is not likely to be concluded in near future, no useful purpose would be served by keeping the petitioner behind the bars. Accordingly, the present petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned.
