Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.142 dated 01.12.2014 under Sections 21 and 22 of the NDPS Act, registered at Police Station Makboolpura, District Amritsar.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that in the present case, the recovery from the present petitioner is 155 grams of intoxicant powder, which, as stated, falls under commercial quantity.
Alprzolam salt has been found in the intoxicant and more than 50 grams falls under commercial quantity. Section 37 of the NDPS Act bars the grant of bail in the cases of commercial quantity. Earlier the interim bail Vineet Gulati 2016.09.19 14:45 I attest to the accuracy and authenticity of this document Chandigarh was granted to the petitioner and then he absented from the proceedings.
CRM No.M-32316 of 2016 -2Keeping in view the fact that commercial quantity has been recovered as per the FIR, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.
Therefore, finding no merit in the present petition, the same is dismissed.
