**** RITU BAHRI , J. (Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.61 dated 21.03.2020, registered at Police Station Sultanpur Lodhi, District Kapurthala, who has been booked for having committed the offence punishable under Section 376/420/354-D/506 IPC and Section 4 of POCSO Act. Learned counsel for the petitioner submits that the allegations against the petitioner is that on the pretext of marriage, he made physical relations with the complainant but the fact is that the complainant knew from the beginning that the petitioner is married and is also having a child. Learned counsel while referring to the contents of the F.I.R mentioned at page No. 4 of the paper book submits that the F.I.R has been registered as there was dispute going on between the petitioner and his brother. Crl. Misc. No. M-16393of 2020 -2counsel for the petitioner states that now the matter has been duly compromised between the parties on 06.07.2020. Learned counsel for the complainant has not denied the factum of compromise effected between the parties on 06.07.2020. The compromise deed is taken on record as Annexure A-1. Learned State counsel states that the medial report of the prosecutrix is still awaited. The challan was presented in March, 2020. Heard.
Petitioner is in custody since 21.03.2020.
Keeping in view the fact that the trial is likely to take some time to conclude and the fact that the matter has been duly compromised between the parties, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kapurthala.
