(ORAL) The present petition has been filed under Section 482 Cr.P.C. for quashing of order dated 10.09.2018 (Annexure P-3) vide which the non bailable warrants have been issued against the petitioner and others on the ground that they have not complied with the judgment dated 09.08.2018 (Annexure P-2) . Learned counsel for the petitioner submits that pursuant to the pervious order the petitioner had appeared before the concerned Court where has been released on probation.
Learned counsel for the petitioner submits that the petitioner had filed an appeal against the conviction before the learned Sessions Court, who had released him on probation and also by payment of Rs.5000/-. He further submits that a sum of Rs.5000/- was paid by him, whereas, it was not paid by the other two convicts. He submits that the present non-bailable warrants have been issued because the money was not paid by the other two persons. Learned counsel has drawn attention of this Court to Annexure P-3 at Page 35 which is the receipt of MANJU 2022.07.11 09:55 I attest to the accuracy and integrity of this document
