Petitioner has filed this petition under Section 482 Cr.P.C. for directing the respondents to conduct re-investigation or further investigation qua rapat No.16 dated 01.09.2011 whereby Section 13

(1) d read with Section 13(2) of the Prevention of Corruption Act, 1988 (PC Act) has been added in case FIR No.62 dated 23.04.2010 under Sections 409 and 420 IPC registered at Police Station, Phillaur, District Jalandhar, by some independent investigating agency or by the Economic Offences Wing of the Vigilance Bureau, Punjab. Notice of motion was issued and learned State counsel appeared and contested the petition.

CRM No.M-35873 of 2011 -2investigation, challan has already been presented and charges have already been framed against the present petitioner. Even it is argued, at the time of arguments, that some of the witnesses have already been examined.

Keeping in view the fact that investigation is already complete, challan has already been presented, charges have already been framed and further the Court has already taken the cognizance and some of the witnesses have already been examined, the present petition seeking direction for re-investigation or further investigation qua report No.16 dated 01.09.2011, has become infructuous and no further action is required in this matter.

Therefore, the present petition is dismissed as having been rendered infructuous.
