(ORAL) The petitioner who is the mother-in-law of respondent No. 2-complainant has filed the present petition under Section 482 Cr.P.C., for quashing of FIR No. 46 dated 20.05.2016 (Annexure P-1) registered under Sections 494, 498-A and 420 read with Section 34 IPC at Police Station Chabbewal, District Hoshiarpur and all subsequent proceedings arising therefrom, on merits.
Perusal of the file shows that for the last 04 dates of hearing i.e. 01.05.2023, 08.08.2023, 18.08.2023 and 20.02.2023, the petitioner had gone un-represented. Today also for the 5th time, the petitioner has gone un-represented, despite the case having been called twice. It is further noticed that the petitioner herein has also filed a separate petition bearing CRM-M-24320-2023 along with her co-accused/son of the petitioner, for quashing of the aforesaid FIR, on RISHU KATARIA 2024.04.25 16:51 I attest to the accuracy and authenticity of this order/judgment.
CRM-M-32355-2016 -2- 2024:PHHC:055932 the basis of compromise dated 5.5.2023 arrived at between the parties, wherein vide order of even date the parties are directed to appear before the learned trial Court/Illaqa Magistrate for recording their statements qua genuineness of compromise. Therefore, it can safely be presumed that the petitioner or her counsel is not interested in pursuing the instant petition as nothing remains to be survived.
Accordingly, the present petition is disposed of, with liberty to the petitioner to revive the same within a period of 03 months from today, if so advised.
