***** ARCHANA PURI, J. (Oral) The applicant/wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/346/2024 titled "Jatin Sidana v/s Nancy Bansal", filed by the respondent/husband, which is pending in the courts at Fatehgarh Sahib and she seeks transfer of the same to the court of competent jurisdiction at Sangrur.
Upon notice, the respondent has made appearance through Sh.Puneet Bhushan, Advocate, who has filed Power of Attorney, which is taken on record. Counsel for the respondent submits that on instructions received from the respondent, he has no objection if the transfer application is accepted and the petition under Section 13 of Hindu Marriage Act, stands transferred from Fatehgarh Sahib to Sangrur.
In view of the submissions made aforesaid and also taking into consideration the fact of one daughter, born from the wedlock of the parties to the lis, to be in the care and custody of the applicant and there are two Sonu 2025.05.06 14:53 I agree to specified portions of this document P&HHC
TA-389-2025 other litigation i.e. petition under Section 175(3) of Bharatiya Nagarik Suraksha Sanhita, i.e. CRM-98-2025 titled "Nancy Bansal v/s Jatin Sidana and others" and complaint under Section 12 of Protection of Women from Domestic Violence Act i.e. COMA/374/2025 titled as "Nancy Bansal v/s Jatin Sidana and others", to be already pending in the courts at Sangrur, which are being pursued by the respondent, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/346/2024 titled "Jatin Sidana v/s Nancy Bansal", filed by the respondent/husband, stands transferred from the Family Court, Fatehgarh Sahib to the Court of competent jurisdiction at Sangrur. The requisite record of the aforesaid case be sent by the Family Court, Fatehgarh Sahib to the District and Sessions Judge, Sangrur.
Learned District and Sessions Judge, Sangrur, shall assign the said petition to the Family Court, Sangrur. Even, the parties are directed to appear before the Family Court, Sangrur, within a period of one month from today onwards.
