RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for issuance of direction to the official respondents to implement the registered document (transfer deed), in the revenue record, the omission, on the part of respondent No.3, in non-implementing the registered document, in the revenue record, at the name of petitioner No.1, is violative of the general instructions contained in 7.4 (iii) of the Punjab Land Records Manual, of 1971 as well as violative of the provisions of Section 33-34-35 of the Punjab Land Revenue Act 1887 and as well as against the law of the land, because respondent No.3 has sine die the mutation No.2032 of village Tut Sher Singh, Tehsil Shahkot, District Jalandhar, petitioner No.
1 wants to take the loan from the financial institute, for agricultural operation and as per the requirement of all the financial institutes (bank etc.) the pre requirement is the name of the owner in the revenue record, thus because of the omission, on the part of respondent No.3, petitioner No.1 is suffering extra ordinary MEENU 2023.11.
CWP-9502-2019 -2hardship because of omission on part of respondent No.3. It has been contended by learned counsel for the petitioners that for redressal of their grievances, they have even issued legal notice, dated 14.08.2018, to respondent No.2, which has been placed on record as Annexure P-3. It has been submitted that till date no action has been taken on the same by respondent No.2.
After hearing counsel for the parties and going through the facts and circumstances of the case, the present petition is disposed of with a direction to respondent No.2, i.e. Deputy Commissioner, Jalandhar, to decide the legal notice, dated 14.08.2018 Annexure P-3, within four weeks from today. It is further directed that the petitioners would be informed forthwith about the decision taken on the legal notice. November 15, 2023 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
