In the High Court for the States of Punjab and Haryana At Chandigarh CRM-M-21049-2021 (O&M) Date of Decision:-27.7.2021 Ravi ... Petitioner

Versus

State of Haryana ... Respondent \

CORAM:

HON'BLE MR. JUSTICE GURVINDER SINGH GILL Present:- Mr. A.P.S. Shergill, Advocate for the petitioner. Mr. Vishal Kashyap, DAG, Haryana, assisted by ASI Anil Kumar.

(proceedings conducted through video conferencing) ***** GURVINDER SINGH GILL, J.(Oral) 1.

The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.131 dated 17.3.2021 at Police Station Civil Line, Kaithal under Sections 379-A and 34 of Indian Penal Code.

2.

The FIR was lodged at the instance of Jasnoor Kaur, wherein it is alleged that on 17.3.2021 when she alongwith her friend Kashish were going home, then three boys came on a motorcycle bearing registration No.HR-08-D-6007 and snatched her mobile phone and fled away from the spot. ( 2 ) CRM-M-21049-2021 (O&M) 3.

Learned counsel for the petitioner submitted that the petitioner is nowhere named in the FIR and has been falsely implicated and, as such, deserves the concession of bail particularly when he is not even involved in any other case.

4.

Opposing the petition, learned State counsel submits that the motorcycle in question i.e. motorcycle bearing registration No.HR-08-D-6007 stands registered in the name of petitioner's uncle and that since the petitioner has also been subsequently identified by the complainant, his complicity is clearly evident. Learned State counsel has, however, informed that the petitioner as on date has been behind bars since the last about 4 months and that he is not involved in any other case.

5.

I have considered rival submissions addressed before this Court. 6.

Having regard to the nature of allegations and the fact that the petitioner has been behind bars since the last about 4 months and is not even stated to be involved in any other case, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
