RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Harjit Kaur @ Sonia in a case arising from FIR No.104 dated 13.05.2018 registered under Section 306 IPC at Police Station Sadar, Phagwara, District Kapurthala. According to the prosecution, petitioner enticed deceased Surinder Kumar for marrying him and also solemnised marriage with him. Thereafter, petitioner performed second marriage with Amanpreet Singh betraying the trust and belief of deceased Surinder Kumar. Therefore, Surinder Kumar committed suicide on 13.05.2018, leaving behind a suicide note mentioning about the false promise of the petitioner and the reason for his death. In the suicide note, the deceased also named parents and husband of the petitioner as accused, who had threatened him with dire consequences.
Learned counsel for the petitioner inter alia contends that Ravinder Singh 2018.08.08 15:53 I attest to the accuracy and authenticity of this document petitioner never promised or married the deceased. It was a one-sided love affair of the deceased with the petitioner. Even the petitioner never
-2CRM-M-32450 of 2018 extended any false promise to the deceased for marrying him. Petitioner is five-months pregnant. No recovery has to be effected from her. The conclusion of trial may take a long time. No useful purpose would be served by keeping the petitioner behind bars. Learned State counsel has vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on her furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
