This order shall dispose of aforesaid two petitions i.e CRM No. M-3428 of 2013 filed by Mukesh Kumar and CRM No. M28491 of 2013 filed by Suresh Kumar & others as both these petitions are out come of the same FIR.

Both these petitions have been filed under Section 482 of the Code of Criminal Procedure for quashing of FIR No.78, dated

CRM No. M-3428 of 2013 (O&M) --2-- 27.01.2013, under Sections 406, 500 IPC, registered at Police Station Jind City, District Jind along with all subsequent proceedings arising therefrom.

Report of learned Jurisdictional Magistrate has been received, in which, it has been categorically observed that compromise is genuine and has been voluntary arrived at between the parties without any coercion or undue influence. Even otherwise, the matter involved is personal in nature, which has been amicably put at rest.

So, in view of above circumstances and in view of pronouncement reported as Gian Singh v. State of Punjab and another; 2012(4) RCR(Criminal) 543, I am of the considered opinion that continuation of criminal proceedings between the parties would be an abuse of the process of law and the present compromise is for their benefit and will bring peace and harmony between them. In view of the above I am of the considered opinion that continuation of criminal proceedings between the parties would be an abuse of the process of law and the present compromise is for their benefit and will bring peace and harmony between them. Consequently, both the petitions are allowed and FIR No.78, dated 27.01.2013, under Sections 406, 500 IPC, registered at Police Station Jind City, District Jind and all other consequential proceedings arising therefrom are quashed qua the petitioner(s).
