The present petition has been filed for grant of regular bail to the petitioner pending trial in a criminal case arising from FIR No. 95 dated 19.05.2020, registered under Section 22/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Garhshankar, District Hoshiarpur.

In a nutshell, the case of the prosecution is that the petitioner was allegedly found with 12 injections of Buprenophine -2 MLs. each. Learned counsel for the petitioner contends that the petitioner is a first time offender. The total quantity recovered from the petitioner is 24 ML. He further submits that the petitioner is in custody since 04.05.2020. Learned counsel for the respondent, on the instructions from Sub Inspector Satwinder Singh, has informed this Court that a report from DEEPAK KUMAR BHARDWAJ 2020.08.25 17:28 I attest to the accuracy and integrity of this document

Criminal Misc. No. M- 16437 of 2020 the Forensic Science Laboratory has not been received yet and therefore, the challan could not be presented. He further submits that as per the custody certificate, the petitioner is not involved in any other case under the Narcotic Drugs & Psychotropic Substances Act, 1985.

Keeping in view the aforesaid facts of the case and without commenting on merits, the present petition is allowed and the petitioner is directed to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the learned trial Court/Chief Judicial Magistrate/Duty Magistrate.
