(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.93 dated 02.05.2020, registered at Police Station Division No. 2, Ludhiana, who has been booked for having committed the offence punishable under Section 363/366-A IPC. Learned counsel for the petitioner submits that the allegations levelled against the petitioner is that he enticed away the daughter of the complainant on the pretext of marriage. Learned counsel submits that as per statement of the daughter of the complainant under Section 164 Cr.P.C, she has not supported the prosecution version and she stated that she was not being kidnapped or abducted by the accused. She had gone with the petitioner at her own free will.

Learned State counsel has supplied the copy of the statement given by the daughter of the complainant. As per this statement, she has nowhere stated that she was enticed by the petitioner or she was kidnapped GAURAV ARORA 2020.07.10 13:37 I attest to the accuracy and integrity of this document Chandigarh

Crl. Misc. No. M- 16422 of 2020 -2or abducted by the petitioner. She only stated that the petitioner threatened her and gave her severe beatings. She further stated that petitioner promised her for marriage. The statement was given in a sound mind, as per report of JMIC, Ludhiana on 04.05.2020. learned State counsel has informed that the challan was presented on 29.06.2020 and out of 10 witnesses, none have been examined so far. Heard.

Petitioner is in custody since 03.05.2020.

Keeping in view the fact that the trial is likely to take some time to conclude, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Ludhiana.
