***** ARCHANA PURI, J. (Oral) Mr. Lajpat Rai Sharma, Advocate, has made appearance on behalf of respondent and filed Power of Attorney, which is taken on record. However, counsel for the respondent, on instructions, submits that he has no objection, if the transfer application is accepted and the divorce petition is transferred from Sonipat to Kaithal.

The applicant/wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/576/2024 titled "Amit v/s Geeta", filed by the respondent/husband, which is pending in the courts at Sonipat and she seeks transfer of the same to the court of competent jurisdiction at Kaithal. Considering the submissions, so made and also taking into consideration the fact of two children born from the wedlock of the parties to the lis, are in the care and custody of the applicant and the other litigation between the parties already pending in the courts at Kaithal as well as taking into consideration the fact of the applicant is not having any source of Sonu 2025.05.14 08:35 I agree to specified portions of this document P&HHC

TA-412-2025 earning, as pleaded in the application, the transfer application is hereby allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/576/2024 titled "Amit v/s Geeta", filed by the respondent/husband, stands transferred from the Family Court, Sonipat, to the Court of competent jurisdiction at Kaithal. The requisite record of the aforesaid case be sent by the Family Court, Sonipat, to the District and Sessions Judge, Kaithal. Learned District and Sessions Judge, Kaithal, shall assign the said petition to the Family Court, Kaithal. Even, the parties are directed to appear before the Family Court, Kaithal, within a period of one month from today onwards.
