RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerParamjeet Singh Dhaliwal, has prayed for grant of regular bail in case FIR No. 0057 dated 24.04.2017, registered under Sections 420, 409, 467, 468, 471 IPC and Section 13(1)(d) and 13(2) of Prevention of Corruption Act, 1988, (added later on) at Police Station City, Sri Muktsar Sahib. According to the prosecution, the petitioner as Senior Manager, cheated his employer bank named as 'The Muktsar Central Co-operative Bank Ltd.', for `96,00,000/- (Rupees Ninety Six Lakhs). Learned counsel inter alia contends that out of 50 prosecution witnesses, as on date only one prosecution witness has been examined. The entire immovable property of the petitioner including the ancestral one, has been attached by the bank. CRM-M-32543-2018 -2since 06.02.2018. No recovery has to be effected from him. Conclusion of trial may take a long time. No useful purpose would be served by detaining the petitioner in jail.

On the other hand, learned State counsel vehemently opposed the above submission of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Paramjeet Singh Dhaliwal, is ordered to be released on bail pending trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
