1. Whether Reporters of local papers may be allowed to see the judgment?
2. To be referred to the Reporters or not?
3. Whether the judgment should be reported in the Digest? AJAY TEWARI, J. (Oral) At the very outset it has been reported that petitioner No.1 has expired and, therefore, the petition qua him stands abated.
Custody certificate dated 11.08.2015 by way of affidavit of Ashok Kumar, Deputy Superintendent, District Jail, Karnal of convict-petitioner No.3 Som Nath has been filed and the same is taken on record.
Custody certificate of petitioner No.2 Rajbir dated 29.03.2011 is already on record.
This revision has been filed against concurrent conviction of the petitioners under Sections 332 and 353 read with Section 34 IPC.
The brief allegations are that on 08.11.95 when a SUNITA NAGPAL 2015.08.14 16:53 I attest to the accuracy and authenticity y of this document Chandigarh
CRR-515-2006(O&M) Haryana Roadways bus bearing registration No. HR05/6174 stopped at village Mohna, the petitioners manhandled and beat the driver and the conductor.
Learned counsel for the petitioners has very fairly stated that he would not press this petition on merits if the Court would consider reduction in sentence. I find that the occurrence took place 20 years ago. In the circumstances I am inclined to accept the fair stand of learned counsel for the petitioners and reduce the punishment of petitioners No. 2 and 3 to six months rigorous imprisonment. Fine remains unchanged. Let them be now arrested to serve out the remaining period of sentence. With the above modification in the order of sentence the present revision petition is dismissed.
Since the main case has been decided, the Criminal Misc. Application, if any, also stands disposed of. (AJAY TEWARI) JUDGE August 12 , 2015 sunita SUNITA NAGPAL 2015.08.14 16:53 I attest to the accuracy and authenticity y of this document Chandigarh
