As per office report, wife of the appellant has stated that her husband has expired on 29.03.2018. It appears that the appellant is not interested in pursuing the matter otherwise the wife could have made alternative arrangement. The appellant is none else but plaintiff in the suit seeking specific performance whereby instead of granting the discretionary relief, alternative relief of recovery of `26,000/- with future interest @6% per annum had been awarded. The appeal filed against the same was also dismissed by the lower Appellate Court. It appears that the appellant has adapted to the ground reality. The appeal is dismissed for default of appearance and non-prosecution.
