******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.136 dated 27.05.2017 registered for offences punishable under Sections 302 read with Section 120-B of Indian Penal Code (for short, "IPC") at Police Station Salhawas District Jhajjar.

Heard.

FIR in this case was registered on the statement of Devender son of Subal Singh, wherein he alleged that his sister, namely, Murti Devi was married with Rattan Singh about 30/32 years back. On 07.05.2017, she was put on fire by her mother-in-law, husband, two sisters-in-law (wives of younger brother of husband) and brothers-in-law (younger brothers of husband) under a conspiracy. Statement of Murti Devi, which was recorded by SHO/ASI Rupesh of Police Post Sasrauli, was not as per her consent or wish.

Allegations against the petitioner are of conspiracy to kill Murti Jitender Kumar 2017.09.20 17:22 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-31647 of 2017 -2Devi. She is 93 years old of age and has been arrested on 09.08.2017. Keeping in view age of the petitioner, it will be a point for investigating officer to see as to whether she had any role in the incident of putting Murti Devi on fire? Case is still at the age of investigation. Presentation of challan and conclusion of trial will take considerably long time. Petition is allowed. Petitioner-Panna Devi is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of her absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel her bail bond and surety bond and proceed to procure her presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) She shall not leave the country without the previous permission of the Court.
