Officer, Garhshankar, submits that insofar as the performance of duties as Sarpanch by the petitioner is concerned, there is no bar. However, with regard to the resolution (Annexure P-2), it is submitted that the Gram Panchayat had passed a resolution for digging of the village pond; however, the wall of the existing pond was demolished without obtaining prior approval from the competent authority. Consequently, a complaint dated 17.01.2026 was submitted by the villagers, which is presently pending consideration before the Block Development and Panchayat Officer, Garhshankar. He further submits that necessary action in the matter shall be taken expeditiously in accordance with law.

Keeping in view the aforesaid submissions made by learned State counsel, no further orders are required to be passed in the present writ petition and the same is, accordingly, disposed of. 4.
