In the High Court of Punjab and Haryana at Chandigarh .....

Criminal Misc. No.M-32613 of 2018 Date of decision:2.8.2018 Mangat Singh alias Baba Mangu

...Petitioner

v.

State of Punjab

...Respondent

....

Coram:

Hon'ble Mr. Justice Inderjit Singh .....

Present:

Mr. Deshpreet Singh, Advocate for the petitioner. .....

Inderjit Singh, J.

The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.48 dated 26.3.2018 registered for the offences under Sections 420, 506 and 120-B IPC at Police Station Guruharsahai, District Fazilka.

I have heard learned counsel for the petitioner and have gone through the record.

As per the allegations in the FIR, Balwinder Singh alias Bindi, Mangat Singh alias Baba Mangu, Raju came to the complainant and started saying that the house in which he is residing there were graves of Muslims in that place. Under that place, 50-60 Kgs. of gold had been buried and that they would extract the same for him. By inducing the complainant as per the FIR version they took `51 lakhs from the complainant. Cr. Misc. No.M-32613 of 2018 [2] petitioner is one of the main accused, who induced the complainant to part with such a huge amount and has committed cheating, therefore, he is required for custodial interrogation.

Keeping in view the facts and circumstances of the present case, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.
