In the High Court of Punjab and Haryana, at Chandigarh Civil Writ Petition No. 9321 of 2022 Date of Decision: 05.05.2022 Savita Devi and Another ... Petitioner(s)
Versus
State of Haryana and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Anil Kshetarpal.
Present:
Mr. Jayender S. Chandail, Advocate for the petitioner(s).
Anil Kshetarpal, J.
1.
The petitioners complain that they have not been paid compensation assessed by the Court for compulsory acquisition of their land. An execution petition, filed by the petitioners, is pending before the Court of the Additional District, Judge, Panchkula. The petitioners claim that in view of the order passed in Pardeep Kumar v. State of Haryana and Others (Civil Writ Petition No. 20384 of 2021, decided on 14.02.2022), the Executing Court should not adopt coercive measures to force the respondents to pay the amount.
2.
In the considered view of the Court, once the matter is pending before the Executing Court as well as before the Division Bench of this Court, the writ petition is not maintainable. Hence, the present writ petition is dismissed.
