AJAY TEWARI, J (ORAL) Prayer is for grant of regular bail in case FIR No.360 dated 30.11.2014 under Sections 395/397/420/411/120-B IPC, P.S Zirakpur, District SAS Nagar, Mohali.

Learned counsel for the petitioner contends that the petitioner has been in custody for almost five months and that similarly situated unnamed co-accused has been granted bail by this Court vide order dated 30.7.2015 in CRM-M-14427 of 2015.

Learned state counsel has not disputed the aforesaid facts. However, he states that recovery was made from the petitioner. Be that as it may, without commenting upon the merits of the case and taking into account the fact that the co-accused of the petitioner has been granted bail and that the trial shall take long time to conclude, no useful purpose would be served by putting the petitioner behind the bars. Accordingly, the petitioner is ordered to be released on bail to the satisfaction of the CJM/Duty Magistrate, SAS Nagar, Mohali. Petition stands allowed.
