RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.70 dated 24.05.2017 registered under Sections 148, 149, 323, 452, 506 IPC (Sections 325, 326, 307 IPC added later on) at Police Station Barara, District Ambala.

According to the prosecution, in the day time of 23.05.2017, petitioner and his co-accused namely, Hari Chand, Sandeep, Niti, Sanju, Pardeep and Ranjeet wife of Pardeep armed with gandasis and lathis trespassed into the house of complainant and gave blows with their respective weapons. Petitioner gave lathi blows to Lovely, Parmeshwari, Tarejana and Daya Ram.

Learned counsel for the petitioner inter alia contends that petitioner has falsely been implicated in the aforesaid FIR case. He is in custody since 25.05.2017. Conclusion of trial may take a sufficient long RAVINDER SINGH 2019.03.15 14:54 I attest to the accuracy and integrity of this document

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner. He contends that complainant and injured witnesses have been examined.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, petitioner is ordered to be released on interim bail for two months on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned. During this period, the trial Court shall make every endeavor to conclude the trial.
