Petitioners have filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.126 dated 27.04.2017 under Sections 457, 380 and 379-B IPC, registered at Police Station Salam Tabri, District Police Commissionerate, Ludhiana.

Mr.Gaurav Garg Dhuriwala, Sr.DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the FIR has been registered on the basis of secret information against so many persons. Recovery is stated to be effected from the present petitioners but there is no FIR got recorded by Vineet Gulati 2017.09.07 10:37 I attest to the accuracy and authenticity of this document Chandigarh anybody regarding theft of those articles as admitted by learned State

The petitioners have been in custody since 29.04.2017. They are not required for any investigation or interrogation purposes as they are in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioners in custody till disposal of the case.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioners are ordered to be released on bail subject to their furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount each to the satisfaction of the trial Court/Duty Magistrate.
