ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of regular bail under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') by filing the second bail application in FIR No.165 dated 06.08.2011, for offence punishable under Sections 420, 465, 467, 468, 471 and 120-B of the Indian Penal Code, 1860 (in short 'IPC') registered at Police Station Navi Baradari, Jalandhar.

Counsel for the petitioner has submitted that the petitioner is in judicial custody since 22.03.2017 and the offences are triable by the Court of Magistrate. It is also submitted that the report under Section 173 Cr.P.C. has already been presented before the trial Court and the petitioner is no more required for any further investigation. The trial Court has already framed the charges against the petitioner and the co-accused. The all other co-accused of the petitioner have already been granted bail. It is further submitted that conclusion of the trial will take long time.

CRM No.M-31792 of 2017 Counsel for the State, on instructions from ASI Malkeet SIngh, has not disputed the factual assertions but opposed the prayer for bail.

Without meaning to express any opinion on merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate. However, it will be open for the prosecution to apply for cancellation of bail, if the petitioner is found involved misusing the concession of bail, in any manner.
