RAMENDRA JAIN, J. (ORAL) 1.

Through this petition under Section 439 Cr.P.C., the petitioner has prayed for grant of regular bail in case FIR No. 54 dated 09.05.2014 registered under Section 22 of the NDPS Act at Police Station Chabbewal, District Hoshiarpur.

Learned counsel for the petitioner contends that the petitioner is in custody since the date of his arrest i.e. 09.05.2017. Final report under Section 173 Cr.P.C. has already been submitted to the Court. Nothing has to be recovered from him.

On the other hand, learned State counsel refuted the submissions made by learned counsel for the petitioner. 4.

I have given my anxious consideration to the submissions made by learned counsel for the parties.

In view of the totality of the facts and circumstances, this Court is of the considered opinion that the petitioner at least deserves the Rishu Kataria 2017.09.07 17:09 I attest to the accuracy and authenticity of this document

Thus, without expressing any opinion on the merits of the case and also the fact that the trial is likely to take time, the instant petition is allowed and the petitioner-Dalvir Singh @ Deera is ordered to be released on regular bail, subject to his furnishing adequate bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate, Hoshiarpur.
