Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.71 dated 06.05.2016 under Sections 420, 467, 471, 120-B, 419 and 403 IPC, registered at Police Station Patti, District Tarn Taran.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. Police record is also available.

From the record, I find that FIR in the present case has been registered against the main accused Randhir Singh with the allegations that Vineet Gulati 2016.10.22 12:19 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-32660 of 2016 -2he presented a fake cheque amounting to `68,70,340/- and on suspicion, he was apprehended as the cheque was fake. During investigation, the present petitioner was nominated by the co-accused. There is no allegation that the petitioner has withdrawn any amount or presented any cheque before the bank for withdrawal of the money. Two cheque books of fake accounts are stated to have been recovered from the petitioner. The petitioner is in custody since 16.05.2016. He is not required for investigation or interrogation purposes as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.

Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
